Ci-dessous, l\u2019int\u00e9gralit\u00e9 du Rapport\u2026<\/p>\n<p class=\"s3\"><span class=\"s9\"><span class=\"bumpedFont15\">Le Parti UNPG se f\u00e9licite de la pr\u00e9sentation de l\u2019avant-projet de la nouvelle constitution devant r\u00e9gir la vie politique guin\u00e9enne apr\u00e8s la pr\u00e9sente transition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. C<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019est un bon signe de l\u2019engagement du CNRD et du Gouvernement pour le retour \u00e0 l\u2019ordre constitutionnel, condition et cadre\u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">juridique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> n\u00e9cessaire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au bon d\u00e9roulement de notre d\u00e9mocratie pluraliste.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Dans l\u2019ensemble, notre Parti a pris bonne note des grandes orientations contenues dans l\u2019avant-projet de constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">C<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ependant, nous tenons \u00e0 faire quelques observations <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">et exprimer <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">des<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pr\u00e9occupations sur certaines dispositions annonc\u00e9es.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Nos observations sont structur\u00e9es sur la base de l\u2019avant-projet de constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> tel qu\u2019il a \u00e9t\u00e9 publi\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<div class=\"s11\">I- <span class=\"s10\"><span class=\"bumpedFont15\">Sur les aspects pr\u00e9liminaires <\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s12\"><span class=\"bumpedFont15\">1. \u00a0<\/span><\/span><span class=\"s13\"><span class=\"bumpedFont15\">Au titre du pr\u00e9ambule <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La mention de l\u2019int\u00e9gration du pr\u00e9ambule dans le bloc de constitutionalit\u00e9 ne nous parait pas n\u00e9cessaire, sauf \u00e0 vouloir consacrer une \u00e9vidence d\u00e9j\u00e0 admise par les juri<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">dictions<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">francophones<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">dernier alin\u00e9a du pr\u00e9ambule).<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En effet, il est \u00e9tabli qu\u2019avant d\u2019\u00eatre un acte juridique encadrant l\u2019organisation et le fonctionnement des institutions \u00e9tatiques et la condition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> juridique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> des citoyens<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u2013 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">bref la construction d\u2019un <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00c9tat<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de droit<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2013 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">la constitution est d\u2019abord un acte politique car au-del\u00e0 du r\u00e9gime institu\u00e9, elle est porteuse d\u2019un projet de soci\u00e9t\u00e9. C\u2019est pourquoi le pr\u00e9ambule<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de la constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> expose l\u2019id\u00e9ologie et les principes de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019ordre d\u00e9mocratique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 construire.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Tirant les cons\u00e9quences de cette r\u00e9alit\u00e9, tous les <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00c9tats<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de l\u2019espace francophone conf<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e8<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">rent une valeur juridique au pr\u00e9ambule, l\u2019int\u00e9grant ainsi dans le bloc de constitutionnalit\u00e9, et toutes les juridictions, notamment constitu<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">tionnelles<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, s\u2019y r\u00e9f\u00e8rent dans l\u2019examen des affaires soumises \u00e0 leur comp<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9tence. Le d\u00e9bat \u00a0sur la question est clos depuis les ann\u00e9es 1970.<\/span><\/span><\/p>\n<p class=\"s5\"><strong><span class=\"s12\"><span class=\"bumpedFont15\">2-<\/span><\/span> <span class=\"s13\"><span class=\"bumpedFont15\">Au titre de la souverainet\u00e9<\/span><\/span><\/strong><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La proposition de l\u2019instauration de la candidature ind\u00e9pendante \u00e0 toutes les \u00e9lections est une source de pr\u00e9occupation pour l\u2019 U N P G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> 45 de l\u2019avant-projet de constitution).<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Les \u00e9lections locales sont des consultations de proximit\u00e9 organis\u00e9es dans <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">es circonscriptions \u00e9lectorale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de taille r\u00e9duite et dans lesquelles la personne du<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">candidat compte plus que <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">les programmes de campagne\u00a0: le fait que les candidats vivent dans ces espaces \u00e9lect<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">oraux<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> o\u00f9 ils sont connus \u00e0 travers leurs r\u00e9alisations \u00e9conomiques et leurs actions s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">o<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">c<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">iales<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">communautaire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, l\u2019emporte plus que toutes autres consid\u00e9rations<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> sur les programmes <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de campagne avec leur cohorte de promesses.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Dans ces conditions, l\u2019instauration de la candidature ind\u00e9pendante aux \u00e9lections locales, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">tout son sens, quitte \u00e0 la <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">loi <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">organiser <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">selon des modalit\u00e9s comme celle d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">u<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">parrainage pr\u00e9vu<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 article 45 de l\u2019avant-projet <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">dont l\u2019int\u00e9r\u00eat est d\u2019\u00e9viter une floraison de candidature<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">fantaisistes<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En revanche, les \u00e9lections politiques <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nationale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">(P<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r\u00e9sident de la <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">R<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9publique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, A<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ssembl\u00e9e <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">N<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ationale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> comme leur <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">appellation<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> l\u2019indique, ont pour champ l\u2019espace territorial national.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ces \u00e9lections imposent aux candidats d\u2019avoir une vision politique nationale et une structure politique capable de soutenir et d\u2019accompagner la mise en \u0153uvre de cette vision en cas de victoire \u00e9lec<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">torale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0: cela signifie que le programme de d\u00e9veloppement du pays propos\u00e9 au peuple pendant la campagne \u00e9lectorale doit \u00eatre port\u00e9 par un parti <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ou mouvement <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">politique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">(comme <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ce fut en<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">France avec le mouvement<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019\u2019EN MARCHE\u2019\u2019 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Emmanuel Macron en 2017)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 m\u00eame de l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u00e9fendre \u00a0devant les citoyens<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">face aux candidatures adverses et de soutenir son ex\u00e9cution apr\u00e8s la victoire. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Face \u00e0 cette r\u00e9alit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> la candidature ind\u00e9pendante \u00e0 l\u2019\u00e9lection pr\u00e9sidentielle ou l\u00e9gislative rel\u00e8ve de l\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ambition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> politique <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">plus<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> que l\u2019exercice normal d\u2019un droit politique. Les r\u00e9sultats de l\u2019\u00e9lection pr\u00e9sidentielle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de fin de transition de 20<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">1<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">0 sont l\u00e0 pour attester le fait\u00a0: sur 24 candidats<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> pr\u00e9sent\u00e9s par des partis politique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> seuls quatre ou cinq ont d\u00e9pass\u00e9 la barre de 1% des suffrages exprim<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">premier<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> tour du scrutin pr\u00e9sidentiel.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> Imagine<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">z<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">qu\u2019elle serait la situation des candidatures ind\u00e9pendantes. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Au-del\u00e0 de cette observation, il convient de souligner que la candidature ind\u00e9pendante \u00e0 une \u00e9lection nationale pose \u00e0 la <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">f<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">oi<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> des probl\u00e8mes politique, juridique et financier<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">majeurs\u00a0:<\/span><\/span><\/p>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">c<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">andidat \u00e0 l\u2019\u00e9lection pr\u00e9sidentielle, le candidat ind\u00e9pendant est souvent un leader sans assise politique certaine, dont le seul id\u00e9al est de faire alliance avec l\u2019un des deux candidats du second tour pour esp\u00e9rer acc\u00e9der \u00e0 un haut poste de responsabilit\u00e9 en cas de victoire; <\/span><\/span><\/div>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">faute de parti politique d\u2019envergure nationale, le candidat ind\u00e9pendant sera\u00a0:<\/span><\/span><\/div>\n<p class=\"s17\"><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">+ <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">un \u00e9lu non inscrit \u00e0 l\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">A<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ssembl\u00e9e <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">N<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ationale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> dont la voix ira <\/span><\/span><\/p>\n<p class=\"s17\"><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">avec<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">le<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">vent, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 moins de s\u2019affilier au groupe parlementaire <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"s17\"><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d\u2019un parti pour pouvoir exister politiquement; <\/span><\/span><\/p>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">connaissant le co\u00fbt d\u2019une campagne \u00e9lect<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">orale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> nationale, l\u2019origine des fonds de campagne, et donc leur lic\u00e9it\u00e9, se pose. Le risque est<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> grand<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019un financement par des personnes au pass\u00e9 sulfureux<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et \u00e0 la moralit\u00e9 douteuse<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> dont l\u2019\u00e9lu serait l\u2019otage; <\/span><\/span><\/div>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">les candidatures ind\u00e9pendantes aux \u00e9lections politiques <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nationales <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ont pour effet, en d\u00e9pit du fait qu\u2019elles rel\u00e8vent de l\u2019exercice d\u2019un droit politique, d\u2019accroitre de fa\u00e7on exponentielle le co\u00fbt du financement de ces \u00e9lections.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> L<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e fait est \u00e0 consid\u00e9rer quand on sait que nous avons r\u00e9guli\u00e8rement recours \u00e0 l\u2019assistance financi<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e8<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> ext\u00e9rieur<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> pour <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">boucler<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> le budget de ces \u00e9lections nationales.<\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En conclusion sur la question des candidatures ind\u00e9pendantes \u00e0 toutes <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">les \u00e9lections, l\u2019UNPG dit oui<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 ces candidatures<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> aux \u00e9lections locales, non aux \u00e9lections politiques nationales.<\/span><\/span><\/p>\n<div class=\"s11\"><strong>II- <span class=\"s10\"><span class=\"bumpedFont15\">Sur la premi\u00e8re partie relative <\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">\u00e0 l\u2019\u00c9tat, aux principes fondamentaux de la R\u00e9publique et aux droits et devoirs (article 7 \u00e0 40 de l\u2019avant-projet de constitution)<\/span><\/span><\/strong><\/div>\n<p class=\"s18\"><span class=\"s13\"><span class=\"bumpedFont15\">Au titre de la promotion parit\u00e9 homme\/femme<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Bien qu\u2019il soit pr\u00e9vu que cette promotion de la parit\u00e9 homme\/femme se fasse dans les conditions pr\u00e9vues par la loi, force est de constater que l\u2019expression <\/span><\/span><span class=\"s19\"><span class=\"bumpedFont15\">\u2019\u2019parit\u00e9 homme\/femme\u2019\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> pose probl\u00e8me ainsi qu\u2019il a \u00e9t\u00e9 relev\u00e9 dans <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">la jurisprudence <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">constitutionnelle de ce<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">rtains<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00c9tats africains<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">: l\u2019expression a \u00e9t\u00e9 parfois jug\u00e9e inconstitutionnel<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">le<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> en tant qu\u2019elle viole le principe constitutionnel d\u2019\u00e9galit\u00e9 des \u00eatres humains, la con<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">firmation<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> r\u00e9sultant du fait que certaines lois nationales fixaient un quota de si\u00e8ges ou de postes<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (30% parfois) <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 r\u00e9server aux femmes dans les organes coll\u00e9giaux ou assembl\u00e9es d\u00e9lib\u00e9ran<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">tes<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> ou sur les listes de candidatures aux \u00e9lections l\u00e9gislatives, ce qui n\u2019a jamais \u00e9t\u00e9 respect\u00e9. <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Aucun Gouvernement, Assembl\u00e9e Nationale ou Conseil <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00c9conomique et Social<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> n\u2019a \u00e9t\u00e9 constitu\u00e9 sur cette base<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> en Guin\u00e9e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">A l\u2019U N P G, nous pensons qu\u2019il vaut mieux faire la promotion du genre, comme l\u2019a fait la constitution de 2020, sur la base d\u2019une combinaison<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">de l\u2019\u00e9galit\u00e9 et de l\u2019\u00e9quit\u00e9. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ainsi les organes coll\u00e9giaux ou assembl\u00e9es d\u00e9lib\u00e9rant<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s ne peuvent \u00eatre compos\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 plus de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">2\/3 de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">membres<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019un m\u00eame sexe. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Cette formule garantit un minimum de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">repr\u00e9sentation du<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">1\/3 aux femmes et laisse ouverte la possibilit\u00e9 d\u2019une \u00e9volution vers l\u2019\u00e9galit\u00e9 parfaite. De plus, elle respecte le principe constitutionnel d\u2019\u00e9galit\u00e9 des \u00eatres humains fond\u00e9e sur le sexe dans la mesure o\u00f9 aucun sexe n\u2019est privil\u00e9gi\u00e9. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Sur le service militaire obligatoire, tel que pr\u00e9vu \u00e0 l\u2019article 26 alin\u00e9a 4 de l\u2019avant-projet de constitution, l\u2019UNPG pense que le service militaire doit \u00eatre optionnel.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L\u2019article 39 de l\u2019avant-projet de constitution prescrit aux citoyens le devoir de loyaut\u00e9 envers la patrie dont celui de d\u00e9fendre l\u2019int\u00e9grit\u00e9 du territoire national et de s\u2019opposer \u00e0 toute forme inconstitutionnelle d\u2019accession, de maintien et de transmission du pouvoir<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L\u2019UNPG pense en cons\u00e9quence, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">que toutes formes d\u2019acc\u00e8s au pouvoir en dehors de celles prescrites par la constitution sont constitutives de crimes contre la suret\u00e9 de l\u2019\u00c9tat et puni<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> comme tel<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. <\/span><\/span><\/p>\n<div class=\"s11\"><strong>III- <span class=\"s10\"><span class=\"bumpedFont15\">Sur la deuxi\u00e8me partie <\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">relative<\/span><\/span> <span class=\"s10\"><span class=\"bumpedFont15\">aux institutions <\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">de la R\u00e9publique<\/span><\/span><\/strong><\/div>\n<div class=\"s16\">1- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre des conditions d\u2019\u00e9ligibilit\u00e9<\/span><\/span> <span class=\"s13\"><span class=\"bumpedFont15\">du Pr\u00e9sident de la R\u00e9publique<\/span><\/span><span class=\"s13\"><span class=\"bumpedFont15\"> (cf. article 45 de l\u2019avant-projet de constitution)<\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Au titre des conditions d\u2019\u00e9ligibilit\u00e9 du Pr\u00e9sident de la R\u00e9publique, l\u2019 UNPG a pr\u00e9c\u00e9demment exprim\u00e9 son opposition \u00a0\u00e0 toute candidature <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ind\u00e9pendante<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> aux \u00e9lections politiques nationale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Relativement au statut du Pr\u00e9sident de la R\u00e9publique, l\u2019interdiction de la double nationalit\u00e9 est pr\u00e9sent\u00e9e comme une incompatibilit\u00e9. Au regard de la l\u00e9gislation guin\u00e9enne, ce n\u2019est pas le cas\u00a0: la double nationalit\u00e9 n\u2019est <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pas <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">un cas d\u2019incompatibilit\u00e9 mais un cas d\u2019in\u00e9ligibilit\u00e9, et cela conform\u00e9ment \u00e0 la lettre de la condition d\u2019\u00e9ligibilit\u00e9 pr\u00e9vue qui dispose <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">que <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">le candidat doit \u00eatre Guin\u00e9en d\u2019origine, n\u00e9 de parents dont un au moins est Guin\u00e9en d\u2019origine. Une interpr\u00e9tation contraire <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ne garantirait pas l\u2019effectivit\u00e9 de l\u2019ex\u00e9cution de l\u2019obligation de renonciation \u00e0 la nationalit\u00e9 \u00e9trang\u00e8re apr\u00e8s l\u2019\u00e9lection dans le d\u00e9lai qui serait prescrit. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Par ailleurs, il est pr\u00e9vu que le Pr\u00e9sident \u00e9lu d\u00e9pose \u00e0 la Cour Constitutionnelle une d\u00e9claration \u00e9crite, sur l\u2019honneur de ses biens en d\u00e9but et en fin de mandat<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> article 60 de l\u2019avant-projet de constitution).<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> Il faut innover sur la question en imposant aux candidats \u00e0 l\u2019\u00e9lection <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pr\u00e9sidentielle de faire la d\u00e9claration de d\u00e9but de mandat plut\u00f4t avant l\u2019ouverture de la campagne \u00e9lectorale. C\u2019est un \u00e9l\u00e9ment d\u2019appr\u00e9ciation de la condition sociale d\u2019un candidat entrant en campagne et de son int\u00e9grit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">en fin de mandat<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> sur la base d\u2019une comparaison avec sa d\u00e9claration de fin de mandat. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">De m\u00eame<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019\u00e2ge plafond de 80<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">ans <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">fix\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au m\u00eame article 45 de l\u2019avant-projet de constitution<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">rel\u00e8ve d\u2019une appr\u00e9ciation m\u00e9dicale qui<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au demeura<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">n<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">t ressort <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">la comp\u00e9tence de la commission m\u00e9dicale \u00e0 instituer par la Cour Constitutionnelle, commission qui doit prendre ses <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">responsabilit\u00e9s en toute ind\u00e9pendance. C\u2019est ce qui avait justifi\u00e9 la suppression en 2010 de l\u2019\u00e2ge plafond.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Selon l\u2019avant-projet de constitutions<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> en son article 66<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> l\u2019avis pr\u00e9alable de certains corps de l\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00c9tat (S\u00e9nat, Conseil Sup\u00e9rieur de la D\u00e9fense Nationale) \u00e0 la nomination par le Pr\u00e9sident de la R\u00e9publique de certaines personnalit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (Premier Ministre, Ministres, Gouverneur<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">et Vice-gouverne<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ur<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s de la BCRG, Chef d\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00c9tat-Major G\u00e9n\u00e9ral <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">des Arm\u00e9es). S\u2019agit-il d\u2019un avis pr\u00e9alable consultatif ou conforme?<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La pr\u00e9cision est importante pour l\u2019accomplissement par le Pr\u00e9sident de la R\u00e9publique des missions qui lui sont d\u00e9volue<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">par la constitution. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">A notre avis, compte tenu de ce que le Pr\u00e9sident de la R\u00e9publique est l\u2019arbitre garant du bon fonctionnement des institutions et chef de l\u2019administration publique, les avis pr\u00e9alables institu\u00e9s dev<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ie<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nt \u00eatre <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">obligatoire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 titre consultatif<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> pour ne pas trop lier le Pr\u00e9sident de la R\u00e9publique qui, en cette qualit\u00e9, a une vision globale des affaires de la R\u00e9publique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 l\u2019oppos\u00e9 des membres des corps appel\u00e9s \u00e0 donner leurs avis. <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">En cas d\u2019avis non conforme il en prend seul la responsabilit\u00e9.<\/span><\/span><\/p>\n<div class=\"s16\">2- <span class=\"s21\"><span class=\"bumpedFont15\">Au titre des rapports entre le Pouvoir ex\u00e9cutif et le Pouvoir l\u00e9gislatif (article 117 \u00e0 138 de l\u2019avant-projet de constitution)<\/span><\/span><\/div>\n<p class=\"s24\"><span class=\"s22\"><span class=\"bumpedFont15\">2-1\u00ab<\/span><\/span><span class=\"s23\"><span class=\"bumpedFont15\">\u00a0Le Premier ministre dispose du pouvoir r\u00e8glementaire qu\u2019il exerce par arr\u00eat\u00e9 dans les domaines d\u00e9termin\u00e9s par la pr\u00e9sente constitution et les lois\u00a0\u00bb.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La Constitution a notamment et essentiellement pour vocation de fixer la r\u00e9partition des domaines de comp\u00e9tence entre les diff\u00e9rents organes de l\u2019Etat. Elle est la loi fondamentale. Autrement dit, elle est la premi\u00e8re des lois dans la hi\u00e9rarchie des normes juridiques.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Seul le peuple a comp\u00e9tence pour la r\u00e9partition des domaines de comp\u00e9tences entre les <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">organes r\u00e9publicains de l\u2019Etat qu\u2019il exerce par la voie du r\u00e9f\u00e9rendum.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">En cons\u00e9quence, le domaine de comp\u00e9tence du Premier ministre ne saurait \u00eatre fix\u00e9 concurremment par le peuple (r\u00e9f\u00e9rendum) et ses repr\u00e9sentants (loi). Il ne peut l\u2019\u00eatre, s\u2019agissant des organes qui consacrent la r\u00e9publique, que par le peuple directement et non \u00e0 travers ses repr\u00e9sentants.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Cette possibilit\u00e9 comporte, d\u2019ailleurs, un risque susceptible d\u2019entra\u00eener des crises institutionnelles. En effet, il serait loisible \u00e0 tout Pr\u00e9sident de la <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">R\u00e9publique disposant d\u2019une majorit\u00e9 parlementaire de r\u00e9duire ou \u00e9tendre le domaine de comp\u00e9tence du Premier ministre au gr\u00e9 de ses int\u00e9r\u00eats sans pour autant passer par la proc\u00e9dure de la r\u00e9vision. <\/span><\/span><\/p>\n<p class=\"s24\"><span class=\"s26\"><span class=\"bumpedFont15\">2-2\u00a0Le Premier ministre nomme aux emplois civils limitativement d\u00e9finis par une loi organique<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Pourquoi renvoyer \u00e0 une loi organique la liste des emplois pour lesquels le Premier ministre dispose du pouvoir de nomination\u00a0? <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Le pouvoir de nomination du Premier ministre, d\u00e8s lors <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">qu\u2019<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">il est partie int\u00e9grante de son pouvoir r\u00e9glementaire doit \u00eatre fix\u00e9 dans son enti\u00e8ret\u00e9 par la constitution au m\u00eame titre que ceux d\u00e9volus au Pr\u00e9sident de la R\u00e9publique. \u00a0<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">D\u2019ailleurs et en tout \u00e9tat de cause, une loi organique n\u2019a pas cette vocation. Elle a pour vocation, sous l\u2019angle strictement juridique, de compl\u00e9ter la constitution dans le sens de <\/span><\/span><span class=\"s27\"><span class=\"bumpedFont15\">son application<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\"> et non dans celui de se <\/span><\/span><span class=\"s27\"><span class=\"bumpedFont15\">substituer \u00e0 elle<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">. Une loi organique ne saurait aller au-del\u00e0 ou en de\u00e7\u00e0 de ce qui dit la constitution<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s26\"><span class=\"bumpedFont15\">2-3 \u00ab\u00a0En cas de d\u00e9saccord persistant entre le Gouvernement et l\u2019Assembl\u00e9e nationale sur des questions fondamentales<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">le Pr\u00e9sident de la r\u00e9publique peut, apr\u00e8s avoir consult\u00e9 le Pr\u00e9sident de l\u2019Assembl\u00e9e nationale, prononcer la dissolution de celle-ci. <\/span><\/span><\/p>\n<div class=\"s28\"><span class=\"s15\">\u2022 <\/span><span class=\"s25\"><span class=\"bumpedFont15\">De nouvelles \u00e9lections ont lieu dans les 90 jours qui suivent la dissolution.<\/span><\/span><\/div>\n<div class=\"s28\"><span class=\"s15\">\u2022 <\/span><span class=\"s25\"><span class=\"bumpedFont15\">Si celles-ci renvoient \u00e0 l\u2019Assembl\u00e9e nationale une majorit\u00e9 de d\u00e9put\u00e9s favorable \u00e0 la position adopt\u00e9e par l\u2019ancienne majorit\u00e9 sur la question qui a provoqu\u00e9 la dissolution, le gouvernement est tenu de renoncer \u00e0 sa position sur l\u2019objet du d\u00e9saccord persistant.<\/span><\/span><\/div>\n<div class=\"s28\"><span class=\"s15\">\u2022 <\/span><span class=\"s25\"><span class=\"bumpedFont15\">Si le Gouvernement ne renonce pas \u00e0 sa position ant\u00e9rieure sur l\u2019objet du d\u00e9saccord persistant, <\/span><\/span><span class=\"s27\"><span class=\"bumpedFont15\">le Pr\u00e9sident de la r\u00e9publique est tenu de d\u00e9missionner\u00a0\u00bb<\/span><\/span> <span class=\"s25\"><span class=\"bumpedFont15\">(cf. article 156 de l\u2019avant-projet de constitution).<\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Un probl\u00e8me de coh\u00e9rence juridique se pose au niveau de cette disposition constitutionnelle.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">En effet, rappelons le postulat constitutionnel qui sous-tend la l\u00e9gitimit\u00e9 des organes de gouvernance constitutionnelle tel que ressorti par cet avant-projet.<\/span><\/span><\/p>\n<div class=\"s28\">a. <span class=\"s25\"><span class=\"bumpedFont15\">Le Pr\u00e9sident de la r\u00e9publique est \u00e9lu au suffrage universel direct. Il tient, par cons\u00e9quent, sa l\u00e9gitimit\u00e9 directement du peuple de Guin\u00e9e devant qui il est responsable et qui seul peut mettre fin \u00e0 ses fonctions dans les conditions d\u00e9finies par la lettre de la constitution.<\/span><\/span><\/div>\n<div class=\"s28\">b. <span class=\"s25\"><span class=\"bumpedFont15\">Le Premier <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">Ministre <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">est responsable devant le Pr\u00e9sident de la r\u00e9publique et non devant l\u2019Assembl\u00e9e nationale.<\/span><\/span><\/div>\n<div class=\"s28\">c. <span class=\"s25\"><span class=\"bumpedFont15\">L\u2019Assembl\u00e9e symbolise la repr\u00e9sentation nationale du pays. Elle est \u00e9galement l\u2019\u00e9manation du suffrage universel direct.<\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Cet avant- projet de constitution semble s\u2019inscrire dans un mod\u00e8le de parlementarisme rationnalis\u00e9 qui s\u2019inspire du r\u00e9gime constitutionnel actuel de la <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">France \u00e0 la diff\u00e9rence que le <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">Premier ministre est responsable devant l\u2019assembl\u00e9e nationale et non devant le Pr\u00e9sident. Pourquoi parlementarisme rationnalis\u00e9e\u00a0?<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Le parlementarisme rationnalis\u00e9 pr\u00f4ne l\u2019\u00e9quilibre des pouvoirs entre un \u00e9l\u00e9ment du pouvoir ex\u00e9cutif, \u00e0 savoir le gouvernement, et le pouvoir l\u00e9gislatif. Cet \u00e9quilibre s\u2019appr\u00e9cie par la capacit\u00e9 dont dispose chacun des deux pouvoirs \u00e0 mettre un terme \u00e0 celui de l\u2019un ou de l\u2019autre dans les conditions d\u00e9termin\u00e9es par la constitution.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Ainsi, autant l\u2019ex\u00e9cutif, \u00e0 travers le Pr\u00e9sident de la r\u00e9publique peut dissoudre l\u2019Assembl\u00e9e nationale par d\u00e9cret, autant l\u2019Assembl\u00e9e nationale peut voter une motion de censure contre le gouvernement dans les conditions d\u00e9termin\u00e9es par la constitution.<\/span><\/span> <span class=\"s25\"><span class=\"bumpedFont15\">En terme de parlementarisme rationalis\u00e9, le pouvoir ex\u00e9cutif est bic\u00e9phale, c\u2019est-\u00e0-dire deux t\u00eate<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">. L\u2019un est un arbitre, l\u2019autre d\u00e9termine et conduit la politique de la nation. C\u2019est pourquoi, il est responsable devant le parlement.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Le Pr\u00e9sident de la R\u00e9publique, en revanche, est au-dessus de la m\u00eal\u00e9e. Il est le garant du fonctionnement r\u00e9gulier des institutions et c\u2019est<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">en <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">cela qu\u2019il est un arbitre dans l\u2019hypoth\u00e8se d\u2019une quelconque crise institutionnelle.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">La motion de censure ne saurait \u00eatre vot\u00e9e contre le Pr\u00e9sident arbitre mais plut\u00f4t contre le gouvernement normalement responsable devant le parlement et non devant lui. C\u2019est parce qu\u2019il est responsable devant l\u2019Assembl\u00e9e nationale que celle \u2013 ci peut voter une motion de censure contre lui. Rappelons \u00e0 cet \u00e9gard que la motion de censure dont dispose l\u2019Assembl\u00e9e nationale est l\u2019\u00e9quivalent du pouvoir de dissolution du Pr\u00e9sident de la r\u00e9publique \u00e0 des fins d\u2019\u00e9quilibre institutionnelle.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">S\u2019il est admis que le Pr\u00e9sident de la R\u00e9publique est le garant du fonctionnement r\u00e9gulier des institutions, donc arbitre, il devient inadmissible qu\u2019une motion de censure soit dirig\u00e9e contre sa personne. Elle ne peut l\u2019\u00eatre que contre la personne responsable devant le parlement. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">C\u2019est pourquoi, nous sugg\u00e9rons :<\/span><\/span><\/p>\n<p class=\"s5\">\u200b<span class=\"s25\"><span class=\"bumpedFont15\">\u2022 de corriger cette incoh\u00e9rence en rendant le Premier ministre responsable non pas devant le Pr\u00e9sident de la r\u00e9publique mais plut\u00f4t devant l\u2019Assembl\u00e9e nationale.<\/span><\/span><\/p>\n<p class=\"s5\">\u200b<span class=\"s25\"><span class=\"bumpedFont15\">\u2022 <\/span><\/span> <span class=\"s25\"><span class=\"bumpedFont15\">de <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">re-\u00e9cri<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">re<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\"> cette disposition dans les termes ci-dessous :<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">\u00ab Si celles-ci<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\"> ( les nouvelles \u00e9lections) <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">renvoient \u00e0 l\u2019Assembl\u00e9e nationale une majorit\u00e9 de d\u00e9put\u00e9s favorable \u00e0 la position adopt\u00e9e par l\u2019ancienne majorit\u00e9 sur la question qui a provoqu\u00e9 la dissolution, le gouvernement est tenu de d\u00e9missionner \u00bb.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s25\"><span class=\"bumpedFont15\">Pour illustrer no<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">s <\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">propos, il est loisible de se r\u00e9f\u00e9rer \u00e0 la derni\u00e8re dissolution de l\u2019Assembl\u00e9e nationale fran\u00e7aise par le Pr\u00e9sident Macron. Le Gouvernement a d\u00e9missionn\u00e9 suite au renvoi par le peuple souverain fran\u00e7ais d\u2019une majorit\u00e9 de d\u00e9put\u00e9s oppos\u00e9s \u00e0 la politique jusque-l\u00e0 men\u00e9e par le Gouvernement. En revanche le Pr\u00e9sident de la r\u00e9publique est demeur\u00e9 dans ses fonction<\/span><\/span><span class=\"s25\"><span class=\"bumpedFont15\">s.<\/span><\/span><\/p>\n<div class=\"s16\"><strong>3- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre des missions et pouvoir<\/span><\/span><span class=\"s13\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s13\"><span class=\"bumpedFont15\"> du Premier Ministre<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 \u00a0Il est pr\u00e9vu que le Premier Ministre prononce un discours de politique g\u00e9n\u00e9rale devant le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">P<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">arlement r\u00e9uni en Conseil de la Nation, au plus tard 60 jours \u00e0 compter de sa nomination<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">article 82 du projet de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">).<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Le d\u00e9lai de 60 jours nous parait court, surtout quand il s\u2019agit d\u2019un Premier Ministre <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">choisi dans le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">secteur priv\u00e9 ou hors de la haute administration. Un d\u00e9lai de 90 jours est de nature \u00e0 lui donner le temps de prendre connaissance des dossiers et de d\u00e9finir l\u2019orientation politique \u00e0 pr\u00e9sent<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">er<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au Parlement. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Par ailleurs, nous constatons que la pr\u00e9sentation du discours de politique g\u00e9n\u00e9rale <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">n\u2019est pas assortie de d\u00e9bat avec les parlementaires et de sanction.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">C\u2019est le lieu de rappeler que le discours de politique g\u00e9n\u00e9rale du Premier Ministre a \u00e9t\u00e9 institu\u00e9 par la constitution de 2010 avec d\u00e9bat sans sanction. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Dans le but d\u2019accroitre les possibilit\u00e9s de contr\u00f4le du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">P<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">arlement sur le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement, la constitution de 2020 a assorti le d\u00e9bat d\u2019un vote parlementaire qui, n\u00e9gatif, entra\u00eenait la d\u00e9mission du Premier Ministre.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Il nous parait d\u2019un int\u00e9r\u00eat politique certain de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">consacrer<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> cette \u00e9volution positive du m\u00e9canisme de 2010 \u00e0 2020 dans la nouvelle constitution \u00e0 venir. <\/span><\/span><\/p>\n<div class=\"s16\"><strong>4- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre du Gouvernement<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Il est pr\u00e9vu des avantages mat\u00e9riels, financiers et de s\u00e9curit\u00e9 d\u00fbs au statut de Premier Ministre et rien pour les anciens Ministres qui, au m\u00eame titre, ont <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">servi le pays.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">A la retraite, ces ministres se contentent d\u2019une maigre indemnit\u00e9 de retraite de 500<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">000<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> GNF<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et rien de plus.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Il est judicieux de pr\u00e9voir pour ces Ministre<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 la retraite une indemnit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<div class=\"s16\"><strong>5- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre des conditions d\u2019\u00e9ligibilit\u00e9 \u00e0 l\u2019Assembl\u00e9e Nationale \u00a0<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Il est pr\u00e9vu un \u00e2ge plancher de 21ans et un \u00e2ge plafond de 80<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">ans et la possibilit\u00e9 des candidatures ind\u00e9pendantes<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf. article 103 de l\u2019avant-projet de class=\"s9\"><span class=\"bumpedFont15\">sa posit<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ion qui est de rejeter toute candidature \u00a0ind\u00e9pendante \u00e0 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">une <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9lection politique nationale. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On peut faire des remarques\u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ur le point relatif \u00e0 l\u2019\u00e2ge planche<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et \u00e0 l\u2019\u00e2ge plafond<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0:<\/span><\/span><\/p>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">sur l\u2019\u00e2ge plancher, est-on plus <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">mur \u00e0 21ans qu\u2019\u00e0 18ans, \u00e2ge de la majorit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> civile<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, de la majorit\u00e9 \u00e9lectorale et de la majorit\u00e9 p\u00e9nale? Nous ne le pensons pas s\u2019agissant de si\u00e9ger \u00e0 l\u2019Assembl\u00e9e Nationale et d\u2019y forger ses armes politiques pour le futur<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">;<\/span><\/span><\/div>\n<div class=\"s16\"><span class=\"s15\">\u2022 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ur l\u2019\u00e2ge plafond, tout est une question de sant\u00e9 personnelle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">O<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">n ne devrait pas faire un parall\u00e8le entre les conditions d\u2019\u00e9lection du Pr\u00e9sident de la R\u00e9publique et celle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> du d\u00e9put\u00e9, eu \u00e9gard aux diff\u00e9rence<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de statut et de fonction. <\/span><\/span><\/div>\n<div class=\"s16\"><strong>6- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre du mode de scrutin de l\u2019Assembl\u00e9e Nationale \u00a0<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Le monopole des candidatures au<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> scrutin <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u00e9gislatif \u00e9tant r\u00e9serv\u00e9 aux partis politiques comme propos\u00e9 ci-dessus, il importe de rappeler que depuis la loi fondamentale de 1990, l\u2019\u00e9lection des d\u00e9put\u00e9s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> a lieu selon un scrutin mixte, \u00e0 savoir pour les 114 d\u00e9put\u00e9s\u00a0:<\/span><\/span><\/p>\n<div class=\"s16\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">le tiers des d\u00e9put\u00e9s au scrutin uninominal majoritaire \u00e0 un tour dans le cadre des pr\u00e9fectures et<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">cinq communes de Conakry, soit 33+5=\u00a038 d\u00e9put\u00e9s; <\/span><\/span><\/div>\n<div class=\"s16\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">les deux tiers des d\u00e9put\u00e9s au scrutin de liste \u00e0 la proportion<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nelle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au plus fort reste, soit 38\u00d72=76 d\u00e9put\u00e9s.<\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ainsi, en fonction de son implantation nationale, chaque <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">parti<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> choisissait le nombre de si\u00e8ge qu\u2019il briguait au scrutin uninominal; s\u2019il d\u00e9cidait de pr\u00e9senter une liste de candidatures, il \u00e9tait tenu d\u2019avoir une liste compl\u00e8te de 76 candidats. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e double scrutin a toujours eu pour effet b\u00e9n\u00e9fique de combiner les avantages des deux modes de scrutin\u00a0: favoriser la formation d\u2019une majorit\u00e9 parlementaire tout en assurant une large repr\u00e9sentation de l\u2019opinion nationale <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019Assembl\u00e9e Nationale. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Cela s\u2019est v\u00e9rifi\u00e9 sous les pr\u00e9sidences des pr\u00e9sidents Lansana Cont\u00e9 et Alpha Cond\u00e9 et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">sous certain<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s l\u00e9gislatur<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">es<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, l\u2019Assembl\u00e9e Nationale comptait en son sein la repr\u00e9sentation d\u2019une quinzaine de partis politique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On ne voit <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">donc <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pas la raison de l\u2019inversion propos\u00e9e de la cl\u00e9 de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r\u00e9partition des<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> candidats \u00e0 l\u2019Assembl\u00e9e Nationale entre les deux modes de scrutin<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (cf. article 106 de l\u2019avant-projet de constitution)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. Il faut d\u2019ailleurs rappel<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">er<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> que l\u2019application de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> la<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> plus forte moyenne pour la r\u00e9partition des si\u00e8ges restants a pour effet de favoriser les petits partis, ce qui a pour cons\u00e9quence une prolif\u00e9ration de ces petits partis \u00e0 l\u2019Assembl\u00e9e Nationale, et donc des difficult\u00e9s \u00e0 const<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ituer<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> des majorit\u00e9s parlementaires stables. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Avec le scrutin mixte appliqu\u00e9 jusqu\u2019\u00e0 pr\u00e9sent et en consid\u00e9rant le red\u00e9coupage communal r\u00e9cent de Conakry en 13 communes, nous avons\u00a0: <\/span><\/span><\/p>\n<div class=\"s16\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">au scrutin uninominal majoritaire \u00e0 un tour\u00a0: 13 communes urbaines de Conakry et 33 pr\u00e9fectures, soit 46 si\u00e8ges uninominaux;<\/span><\/span><\/div>\n<div class=\"s16\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">au scrutin <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">liste<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">proportionnelle au plus fort reste\u00a0:<\/span><\/span><\/div>\n<p class=\"s31\"><span class=\"s9\"><span class=\"bumpedFont15\">46 si\u00e8ges <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">x<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> 2=<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">92<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> si\u00e8ges.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Soit une Assembl\u00e9e Nationale de 46+92= 138 si\u00e8ges.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On constate ainsi par rapport \u00e0 l\u2019ancienne composition parlementaire une augmentation de 138 si\u00e8ges-114 si\u00e8ges= 24 si\u00e8ges. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">C\u2019est une progression appr\u00e9ciable dans l\u2019\u00e9volution du nombre de d\u00e9put\u00e9s. Il faut \u00e9viter de s\u2019engager dans des r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">formes constitutionnelles dont la mise en \u0153uvre \u00e0 court terme serait source de difficult\u00e9s aux cons\u00e9quences impr\u00e9visibles lors des scrutins l\u00e9gislati<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">f<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s. <\/span><\/span><\/p>\n<div class=\"s16\"><strong>7- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre du S\u00e9nat<\/span><\/span><span class=\"s13\"><span class=\"bumpedFont15\"> ( article 108 \u00e0 113 de l\u2019avant-projet de constitution)<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Sur un plan g\u00e9n\u00e9ral, la cr\u00e9ation d\u2019un <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">S<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9nat consacrerait l\u2019instauration pour la premi\u00e8re fois en Guin\u00e9e du bicam\u00e9ralisme dont on voit mal la justification. Le S\u00e9n\u00e9gal qui a fait l\u2019exp\u00e9rience du S\u00e9nat, l\u2019a supprim\u00e9.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">A l\u2019examen de sa composition telle que propos\u00e9e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> il<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> ne<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> s\u2019agit ni plus ni moins que d\u2019une fusion de l\u2019ancien C<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">onseil \u00c9conomique et <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">S<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ocial<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">et du Haut Conseil des collectivit\u00e9s locales qui n\u2019a jamais vu le jour depuis 2010. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Par cette composition qui r\u00e9serve \u00e0 la nomination par le Pr\u00e9sident de la R\u00e9publique du 1\/3 des membres du S\u00e9nat, on se convainc <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ais\u00e9ment<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> qu\u2019elle serait une maison de retraite pour les <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">amis et alli\u00e9s politiques du Pr\u00e9sident de la R\u00e9publique. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Le vote de la loi et le contr\u00f4le de l\u2019action <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">gouvernementale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> par une assembl\u00e9e d\u00e9lib\u00e9rante sont des missions \u00e9minemment politique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. On ne peut dans ces conditions \u00e9tablir que les fonctions de s\u00e9nateur sont incompatibles avec l\u2019exercice de toute activit\u00e9 au sein d\u2019un parti ou d\u2019un mouvement politique. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Cette contradiction se double d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">u <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">fait, ainsi qu\u2019il est \u00e9crit, qu\u2019en mati\u00e8re non l\u00e9gislative et dans le cadre de la promotion de la paix sociale et de l\u2019unit\u00e9 nationale, le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">S<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9nat contribuerait \u00e0 la pr\u00e9vention et \u00e0 la gestion des conflits entre les couches de la nation et au renforcement du dialogue inter<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2013<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">guin\u00e9en, en plus d\u2019\u00eatre le gardien de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">us <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">et coutumes. Des attributions non<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u00e9gislatives<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">\u00a0 \u00a0 injustifi\u00e9es et qui ne reposent sur rien! <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En mati\u00e8re l\u00e9gislative, le S\u00e9nat envisag\u00e9 est une chambre parlementaire diminu\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0: elle a des comp\u00e9tences d\u2019attribution express\u00e9ment \u00e9num\u00e9r\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">es<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. Du coup<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> se pose la question de l\u2019int\u00e9r\u00eat d\u2019un bicam\u00e9ralisme in\u00e9galitaire dans notre pays. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Cette question se couple avec l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e risque<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de compliquer la proc\u00e9dure l\u00e9gislative<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">q<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ue nos d\u00e9put\u00e9s maitrisent peu, avec l\u2019institution du S\u00e9nat.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Au plan financier, o<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">n<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> rel\u00e8ve<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">aussi le caract\u00e8re budg\u00e9t<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ivore<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019une telle institution dont l\u2019efficacit\u00e9 en terme<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">de r\u00e9sultats ne peut \u00eatre appr\u00e9ci\u00e9e. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En somme<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> en l\u2019\u00e9tat actuel de l\u2019\u00e9volution de la Guin\u00e9e, un parlement monocam\u00e9ral, la seule Assembl\u00e9e Nationale, suffit \u00e0 assurer un<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> large <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">repr\u00e9sentation du peuple. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s33\"><span class=\"bumpedFont15\">Si la pr\u00e9occupation est d\u2019assurer une <\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">repr\u00e9sentat<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">i<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">on <\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">nationale aux organ<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">isations<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">socio-professionnel<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">les<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> et aux collectivit\u00e9s locales, la fusion de l\u2019ancien C<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">onseil \u00c9conomique et <\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">S<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">ocial<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> et du Haut Conseil des Collectivit\u00e9s locales devrait \u00eatre envisag\u00e9 en une seule institution constitutionnelle consultative \u00e0 cr\u00e9er. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s33\"><span class=\"bumpedFont15\">Notons enfin que la mise en place du S\u00e9nat prendrait du temps<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">toutes les communes ayant \u00e9t\u00e9 remplac\u00e9es par des d\u00e9l\u00e9gations sp\u00e9ciales non \u00e9lues; de plus les assembl\u00e9es r\u00e9gionales n\u2019ont jamais exist\u00e9, encore qu\u2019en l\u2019esp\u00e8ce<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> il fai<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">lle<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> d\u2019abord proc\u00e9der \u00e0 un nouveau d\u00e9coupage<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> administratif<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> r\u00e9gional en Guin\u00e9e Foresti\u00e8re pour lui permettre d\u2019avoir deux r\u00e9gions administratives comme les trois autres r\u00e9gions naturelles<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">\u00a0:<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> la Basse Guin\u00e9e avec Kindia et Bok\u00e9, la Moyenne Guin\u00e9e <\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">avec Mamou et Lab\u00e9 et la Haute Guin\u00e9e avec Kankan et Faranah, ce<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\">ci<\/span><\/span><span class=\"s33\"><span class=\"bumpedFont15\"> dans l\u2019esprit de promotion de l\u2019\u00e9quit\u00e9 r\u00e9gionale. <\/span><\/span><\/p>\n<p class=\"s5\"><strong><span class=\"s34\"><span class=\"bumpedFont15\">IV- <\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">Sur les institutions juridictionnelles<\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">(article 139 \u00e0 171 de l\u2019avant-projet de constitution)<\/span><\/span><\/strong><\/p>\n<div class=\"s28\"><strong>1- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre de la Cour constitutionnelle<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Une remarque majeure s\u2019impose ici. Rien ne figure dans l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019avant-projet de constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> sur le mode de d\u00e9signation du Pr\u00e9sident de la Cour Constitutionnelle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0:<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> par nomination du Pr\u00e9sident de la R\u00e9publique ou par \u00e9lection par ses pairs comme dans la constitution de 2010<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0?<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> Le principe dev<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ait \u00eatre pos\u00e9 dans la constitution et non dans une loi organique.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Par ailleurs<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">aucune mention n\u2019est faite du renouvellement partiel des membres de la Cour Constitutionnelle en cours de mandat, \u00e0 moins d\u2019envisager que d\u00e8s sa premi\u00e8re composition, tous les membres de la Cour <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">b\u00e9n\u00e9ficieront de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> la dur\u00e9e de mandat de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">neufs ans non renouvelables<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<div class=\"s28\"><strong>2- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre\u00a0 de la Cour Sp\u00e9ciale de justice de la R\u00e9publique.<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En fait<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">il ne s\u2019agit ni plus ni moins que de l\u2019ancienne Haute Cour de Justice qui n\u2019a v\u00e9ritablement pas fonctionn<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, bien qu\u2019elle ait \u00e9t\u00e9 constitu\u00e9e parfois depuis 1990.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Si le besoin est de chang<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">er<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">appellation<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, il convient de supprimer le qualificatif <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019\u2019<\/span><\/span><span class=\"s19\"><span class=\"bumpedFont15\">sp\u00e9ciale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u2018\u2019 pour ne pas<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">donner<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 la Cour<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> l\u2019allure d\u2019une juridiction d\u2019exception<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">comme l\u2019ancienne Cour de s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00fb<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ret\u00e9 de l\u2019Etat) alors qu\u2019en dehors de<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">quelques <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">questions proc\u00e9durale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">la Cour<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">appliquera<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">g\u00e9n\u00e9ralement sur le fond les dispositions p\u00e9nales \u00a0de droit commun.<\/span><\/span><\/p>\n<p class=\"s5\"><strong><span class=\"s35\"><span class=\"bumpedFont15\">V<\/span><\/span><span class=\"s34\"><span class=\"bumpedFont15\">\u2013 <\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">Sur la troisi\u00e8me partie relative aux titres sp\u00e9cifiques<\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\"> (articles 185 \u00e0 205 de l\u2019avant-projet de constitution)<\/span><\/span><\/strong><\/p>\n<div class=\"s28\">1- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre de l\u2019organisation territoriale <\/span><\/span><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Les indications y relatives et contenues dans le rapport de pr\u00e9sentation de l\u2019avant-projet de la constitution n\u00e9cessite<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nt<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> des pr\u00e9cisions\u00a0:<\/span><\/span><\/p>\n<div class=\"s28\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019appellation <\/span><\/span><span class=\"s19\"><span class=\"bumpedFont15\">\u2018\u2019province\u2019\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> va-t-elle s\u2019appliqu<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">er<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">aux r\u00e9gi<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">on<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s administrati<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ves <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">actuelles\u00a0?<\/span><\/span><\/div>\n<div class=\"s28\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">selon<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> l\u2019avant-projet de constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, les collectivit\u00e9s d\u00e9centralis\u00e9es sont les r\u00e9gions naturelles et les communes. <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Alors<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> se pose la question du sort des r\u00e9gions administratives par rapport aux quatre r\u00e9gions naturelles d\u00e9clar\u00e9es <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">collectivit\u00e9s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u00e9centralis\u00e9es.<\/span><\/span><\/div>\n<p class=\"s24\"><span class=\"s9\"><span class=\"bumpedFont15\">Par ailleurs<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">les principes d\u2019autonomie et de participation devraient \u00eatre inscrits dans la constitution comme fondement de l\u2019organisation territoriale.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (voir formulation de la constitution de 2020).<\/span><\/span><\/p>\n<div class=\"s28\"><strong>2- <span class=\"s13\"><span class=\"bumpedFont15\">Au titre de la r\u00e9vision \u00a0de la constitution<\/span><\/span><\/strong><\/div>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">De l\u2019avant-projet de constitution, il r\u00e9sulte que, relativement aux implications institutionnelles des projets de r\u00e9vision constitutionnelle soumis \u00e0 la proc\u00e9dure r\u00e9f\u00e9rendaire, le Gouvernement doit pr\u00e9senter imm\u00e9diatement sa d\u00e9mission qui ne peut \u00eatre refus\u00e9e par le Pr\u00e9sident de la R\u00e9publique, au lendemain du r\u00e9f\u00e9rendum quel que soit le r\u00e9sultat du processus, c\u2019est-\u00e0-dire que le r\u00e9f\u00e9rendum soit positif ou n\u00e9gatif. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On ne manquera pas de trouver l\u00e0 une curiosit\u00e9 juridique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 moins que le Pr\u00e9sident de la R\u00e9publique ait mis son mandat en jeu \u00e0 l\u2019occasion du projet r\u00e9f\u00e9rend<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">aire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> comme le faisait le G\u00e9n\u00e9ral de Gaulle, surtout qu\u2019en l\u2019esp\u00e8ce l\u2019initiative du projet de r\u00e9vision constitutionnelle soumis \u00e0 la proc\u00e9dure r\u00e9f\u00e9rend<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">aire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> ne rel\u00e8ve pas du \u00a0Premier Ministre et du Gouvernement mais du Pr\u00e9sident \u00a0de la R\u00e9publique. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Par ailleurs, toujours au titre des implications institutionnelles, il est pr\u00e9vu qu\u2019aucun membre du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement d\u00e9missionnaire ne peut \u00eatre promu \u00e0 une fonction \u00e9quivalente ou sup\u00e9rieure jusqu\u2019au terme du mandat en cours du Pr\u00e9sident de la R\u00e9publique. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Il y aurait l\u00e0 une disposition attentatoire aux droits des membres du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement d\u00e9missionnaire. Le r\u00e9sultat positif ou n\u00e9gatif d\u2019un r\u00e9f\u00e9rendum constitutionnel initi\u00e9 \u00a0par le Pr\u00e9sident de la R\u00e9publique et non <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">par <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement ne peut affecter le droit \u00a0pour les membres du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement d\u2019acc\u00e9der \u00e0 d\u2019autres hautes fonctions publiques, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ou <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">m\u00eame \u00e0 une fonction <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">m<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">inist\u00e9rielle dans un <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement form\u00e9 ult\u00e9rieurement.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ces remarques sont valables au cas de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r\u00e9vision constitutionnelle<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> par voie parlementaire\u00a0: il est pr\u00e9vu aussi la dissolution obligatoire de l\u2019Assembl\u00e9e par le Pr\u00e9sident de la R\u00e9publique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">quel<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">le<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> que soit l\u2019issue du processus, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">comme si les d\u00e9put\u00e9s avaient commis un crime. La logique du m\u00e9canisme est difficilement saisissable.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On est donc amen\u00e9 \u00e0 se demander de quelle r\u00e9vision constitutionnelle il s\u2019agit\u00a0: est-ce le changement de toute la constitution ou simplement la r\u00e9vision de certaine<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">de ses <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">disposition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0? \u00a0Dans un cas comme dans l\u2019autre, la sanction \u00a0politique pr\u00e9vue \u00a0(d\u00e9mission du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement \u00a0ou dissolution obligatoire de l\u2019Assembl\u00e9e Nationale) ne r\u00e9pond \u00e0 aucune logique juridique\u00a0: elle est inopportune<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a r\u00e9vision a pour objet d\u2019adapter les dispositions constitutionnelles \u00e0 l\u2019\u00e9volution politique du pays afin que l\u2019encadrement juridique des r\u00e9alit\u00e9s nationales soit effectif\u00a0; elle ne sert pas \u00e0 sanctionner le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement ou l\u2019Assembl\u00e9e Nationale.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Relativement \u00e0 la protection de la future constitution et \u00e0 sa p\u00e9rennit\u00e9, il est pr\u00e9vu qu\u2019aucune de ses dispositions ne peut faire l\u2019objet de r\u00e9vision avant l\u2019expiration d\u2019un d\u00e9lai \u00a0de 30 ans \u00e0 compter de sa date \u00a0de promulgation\u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">(cf. <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">article 198 alin\u00e9a 17 de l\u2019avant-projet de constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">; certains principes et valeur<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">comme la forme r\u00e9publicaine de l\u2019Etat, le principe de la\u00efcit\u00e9 de l\u2019Etat ou le principe de la limitation du nombre et de la dur\u00e9e du mandat pr\u00e9sidentiel, sont exclus de toute possibilit\u00e9 de r\u00e9vision. Tout un r\u00e9gime de sauvegarde de la constitution tendant \u00e0 emp\u00eacher tout changement de r\u00e9gime est \u00e9labor\u00e9.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ces dispositions de l\u2019avant-projet de constitution appellent<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> quelques<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> observations.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En premier<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> lieu, nul ne peut avoir la maitrise de l\u2019\u00e9volution politique d\u2019un Etat pendant 30 ans, \u00e0 moins d\u2019\u00eatr<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e un d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">vin<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. L<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a dur\u00e9e dans le temps de la constitution d\u2019un pays ne se d\u00e9cr\u00e8te pas. On ne peut trouver une disposition de ce genre dans la constitution am\u00e9ricaine de 1787 ou la constitution fran\u00e7ais<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de 1958 et m\u00eame dans celles de la plupart des Etats africain, qui ont fait et font <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r\u00e9guli\u00e8rement l\u2019objet<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">d\u2019amendement ou de r\u00e9vision pour<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> les<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> adapter au <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">contexte politique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">du moment ou r\u00e9soudre<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> quelques<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> probl\u00e8me<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pratique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019application de certaines disposition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. La dur\u00e9e de la constitution se construit dans <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">le c\u0153ur et <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019esprit des citoyens. Aussi, nous pensons que la disposition interdisant toute r\u00e9vision, \u00e0 l\u2019exception d\u2019un cas pr\u00e9vu, pendant 30 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ans est<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> inutile.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En second lieu, la bonne gouvernance politique, \u00e9conomique, financi\u00e8re et sociale du pays est et demeure la garantie absolue des principes et valeurs exclus de toute possibilit\u00e9 de r\u00e9vision et la seule protection efficace contre tout changement anticonstitutionnel de r\u00e9gime politique, situation d\u00e9j\u00e0 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">condamn\u00e9e sans<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> effet par l\u2019Union Africaine et la CEDEAO.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L\u2019histoire r\u00e9cente de la <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">uin\u00e9e nous l\u2019enseigne\u00a0: le coup d\u2019Etat militaire du 05 septembre 2021 n\u2019a pas pour origine la constitution d\u00e9cri\u00e9e de 2020 qui a servi de base l\u00e9gale \u00e0 une \u00e9lection pr\u00e9sidentielle \u00a0en octobre 2020, \u00e9lection \u00e0 laquelle a particip\u00e9 le principal \u00a0opposant politique au \u00a0r\u00e9gime du Pr\u00e9sident Alpha Cond\u00e9\u00a0; il est le r\u00e9sultat de la mal gouvernance \u00e9conomique et financi\u00e8re criarde faite de gabegie financi\u00e8re, \u00a0de corruption<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de d\u00e9tournement de deniers publics impunis, de paralysie de l\u2019administration publique, tout cela sans aucun respect pour le peuple guin\u00e9en<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">U<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ne<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> mal gouvernance qui a caract\u00e9ris\u00e9 le r\u00e9gime du Pr\u00e9sident Alpha Cond\u00e9 apr\u00e8s sa r\u00e9\u00e9lection pour un troisi\u00e8me mandat.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">En Afrique, le soul\u00e8vement populaire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> au <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">Burkina-Faso<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> qui a entrain\u00e9 la chute du Pr\u00e9sident Blaise Compaor\u00e9 en 2014 est une autre illustration de ce qu\u2019un changement anti- constitutionnel de r\u00e9gime peut su<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">r<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ve<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">nir<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 tout moment, sans aucune planification, <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 la surprise du<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> pouvoir en place.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La r\u00e9cente fuite <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 l\u2019\u00e9tranger <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de la Premi\u00e8re Ministre du Bengladesh suite \u00e0 une \u00e9meute populaire expose davantage l\u2019impr\u00e9visibilit\u00e9 des brusques changements de r\u00e9gime politique. Quand un tel \u00e9v\u00e8nement survient, l\u2019effectivit\u00e9 de la d\u00e9tention du pouvoir d\u2019Etat intervient dans les relations internationales comme justification de la reconnaissance internationale de r\u00e9gimes de fait. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Quand la bonne gouvernance n\u2019est plus l\u00e0, le peuple renonce \u00e0 d\u00e9fendre la constitution et c\u2019est la porte ouverte \u00e0 toutes les vell\u00e9it\u00e9s politiques. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">C\u2019est pourquoi \u00e0 l\u2019UNPG, nous disons oui \u00e0 de beaux textes mais l\u2019essentiel reviendra non pas \u00e0 la constitution \u00e0 travers ses dispositions, mais au <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ouvernement qui aura en charge la conduite des affaires de l\u2019Etat et surtout \u00e0 la Commission Nationale pour le <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">D<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9veloppement et \u00e0 la Commission Nationale de l\u2019<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">E<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ducation <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">C<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ivique et des <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">D<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">roits de l\u2019Homme<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, en association avec les structures d\u2019Etat et les agences de lutte contre la corruption. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Ces Commissions Nationales auront la lourde mission de\u00a0:<\/span><\/span><\/p>\n<div class=\"s28\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">v<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">eiller \u00e0 la bonne conduite de la politique \u00e9conomique nationale dans le respect de l\u2019\u00e9quit\u00e9 r\u00e9gi<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">onale<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et de l\u2019identit\u00e9 nationale\u00a0;<\/span><\/span><\/div>\n<div class=\"s28\"><span class=\"s32\">\u2013 <\/span><span class=\"s9\"><span class=\"bumpedFont15\">a<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ssurer la bonne \u00e9ducation civique dans le sens \u00a0du respect de la chose publique et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019inculturation des principes et valeurs de la soci\u00e9t\u00e9 politique que<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> la nouvelle constitution<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">tend \u00e0 construire.<\/span><\/span><\/div>\n<p class=\"s5\"><strong><span class=\"s35\"><span class=\"bumpedFont15\">VI- \u00a0<\/span><\/span><span class=\"s10\"><span class=\"bumpedFont15\">Sur les dispositions transitoires et finales<\/span><\/span><\/strong><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Deux des dispositions transitoires retiennent notre attention.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Selon la premi\u00e8re disposition<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (article 202 de l\u2019avant-projet de constitution)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, en attendant la mise en place des institutions consacr\u00e9es par la nouvelle constitution \u00e0 venir, les organes de la transition demeurent comp\u00e9tent<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">pour exercer les fonctions, missions et <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">attributions qui<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> leur sont d\u00e9volues par la charte de la transition du 27 septembre 2021.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Les institutions sont r\u00e9gies par <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">es r\u00e8gles qui les autorisent \u00e0 accomplir certains actes ou op\u00e9rations <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> leur interdisent d\u2019autres. Dans cet esprit, il serait <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">opportun <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de rappeler dans la nouvelle constitution l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">es <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">article<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">46<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et 55<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de la charte de la transition.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">L\u2019engagement du CNRD sur la<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">question a \u00e9t\u00e9 affirm\u00e9 et r\u00e9affirm<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 plusieurs reprises.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La constitution ne d\u00e9signe pas nomm\u00e9ment les personnes aptes \u00e0 participer \u00e0 une \u00e9lection\u00a0: elle \u00e9nonce avant l\u2019\u00e9lection les in\u00e9ligibilit\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et apr\u00e8s l\u2019\u00e9lection les incompatibilit\u00e9s en fonction de l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">a<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">qualit\u00e9 et <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">du <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">statut juridique<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> des candidats<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. Dans le contexte actuel de la Guin\u00e9e, il est \u00e9tabli que le Pr\u00e9sident de la Transition restera en fonction jusqu\u2019\u00e0 l\u2019investiture du prochain Pr\u00e9sident \u00e9lu. On comprend d\u00e8s lors que l\u2019avant-projet de constitution prescrive dans une de ses dispositions transitoire<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> la prorogation des dispositions de la Charte de la Transition jusqu\u2019\u00e0 la mise en place des nouvelles institutions constitutionnelles. Ainsi donc l\u2019analyse combin\u00e9e des dispositions de la Charte de la Transition (notamment en ses articles 46 et 55) et de celles de la nouvelle constitution exclut n\u00e9cessairement la candidature des Pr\u00e9sident et membres du CNRD ainsi que celle du Premier Ministre<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> et des membres du Gouvernement. L\u2019int\u00e9r\u00eat d\u2019une telle analyse <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">est<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> d\u2019assurer la neutralit\u00e9 des diff\u00e9rents scrutin<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 venir, leur cr\u00e9dibilit\u00e9 et leur transparence. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">C\u2019est l\u2019occasion de souligner que la constitution en cours d\u2019\u00e9laboration trouve sa l\u00e9galit\u00e9 et m\u00eame sa l\u00e9gitimit\u00e9 dans la Charte de la Transition qui a \u00e9dict\u00e9 les principes et r\u00e8gles de sa r\u00e9daction et de son <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">adoption et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> dont les organes ont la charge de la gestion de l\u2019Etat. <\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Selon la deuxi\u00e8me disposition transitoire retenue pour nos observations,<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> (article 204 de l<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019avant-projet de constitution)<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> les lois <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d\u2019amnistie<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">adopt\u00e9es durant la p\u00e9riode de transition ob\u00e9issent \u00e0 un r\u00e9gime juridique par<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ticulier<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> qu\u2019elles d\u00e9terminent.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">La formulation de la disposition constitutionnelle en cause est des plus curieuses.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">S\u2019agit-il des lois <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">d\u2019amnistie <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">adopt\u00e9es d\u00e9j\u00e0 <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ou <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00e0 adopter<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0?<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> La seconde hypoth\u00e8se correspond \u00e0 la r\u00e9alit\u00e9 car \u00e0 notre connaissance, aucune loi d<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u2019amnistie<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> n\u2019a \u00e9t\u00e9 vot\u00e9e depuis l\u2019installation du CNT en 2022.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">A propos du r\u00e9gime juridique par<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ticulier<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> \u00e0 d\u00e9terminer auquel il est fait allusion, on se demande bien de quel r\u00e9gime juridique il s\u2019agit car l\u2019amnistie est r\u00e9gie en <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">G<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">uin\u00e9e par les articles 1242 \u00e0 1245 du code de proc\u00e9dure p\u00e9nal<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">On s\u2019interroge enfin sur l\u2019int\u00e9r\u00eat ou l\u2019opportunit\u00e9 \u00a0de cette disposition de l\u2019avant- projet de la constitution. S\u2019agit-il pour les autorit\u00e9s de la transition de se prot\u00e9ger contre toute poursuite \u00e0 la fin de cette transition car, comme dispose l\u2019article 1244-2 du code de proc\u00e9dure p\u00e9nal<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">, avant la condamnation d\u00e9finitive, l\u2019amnistie rend cette condamnation impossible par l\u2019effet de l\u2019extinction de l\u2019action publi<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">que<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">\u00a0?<\/span><\/span> <span class=\"s9\"><span class=\"bumpedFont15\">I<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l p<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">ourrait<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">s\u2019agir aussi d\u2019une amnistie \u00e0 la carte, \u00e0 des fins \u00e9lectorales<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">. I<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l reste<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> cependant <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">que malgr\u00e9<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">l\u2019amnistie, l\u2019article 1245 du code de proc\u00e9dure p\u00e9nal<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">e<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> r\u00e9serve les droits des tiers, les r\u00e9parations <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">civiles et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> dommages-int\u00e9r\u00eats etc. \u00e0 la <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">charge des<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">auteurs d\u2019infractions amnisti\u00e9es.<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> En clair, l\u2019amnistie supprime<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> toute peine<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> de <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">prison et<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">toute trace de l\u2019infraction dans le pass\u00e9 ou le casier judiciaire de l\u2019auteur mais laisse subsister la possibilit\u00e9 d\u2019une condamnation \u00e0 des r\u00e9parations civiles au profit des victimes (Etat ou personnes priv\u00e9es).<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Telles sont les pr\u00e9occupations, observations et suggestions de l\u2019UNPG dans le d\u00e9bat <\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">constitutionnel en<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> cours.<\/span><\/span><\/p>\n<p class=\"s5\"><span class=\"s9\"><span class=\"bumpedFont15\">Certaines dispositions de l\u2019avant -projet de la constitution comportent en<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\"> en elles des risques<\/span><\/span><span class=\"s9\"><span class=\"bumpedFont15\">de difficult\u00e9s d\u2019application certaines.
